Judge Anita Sukola of Superior Court of Guam released Silves Mikel from custody on Thursday, November 29, 2018, dismissing charges of criminal sexual conducts without prejudice. Dismiss without prejudice means the case can be raised again by plaintiff should evidence comes up warranting the charges.
Silves Mikel, a 59-year-old Palauan, was charged on three counts of sexual misconduct for allegedly inappropriately touching and photographing 3 minors while they were sleeping.
According to report from Guam news, one of the girls reported to the police that she felt Mikel touching her and when she moved, went on to touch other girls.
Mr. Silves denied any wrong doing, claiming he had no recollection of such happenings as he had drunk about eight to nine beers that night.
According to copy of record circulating on social media, the judge had dismissal of the case saying not enough evidence to charge the defendant. Case is dismissed without prejudice. (L.N. Reklai)
